3. Website Content and Services

The Website is intended to provide general information about insurance products, services, and resources offered or discussed by the Agency. The Website may include information concerning:

The Website may also provide:

The Website and its content are provided for general informational purposes only. Website content is not a substitute for individualized advice, a formal insurance application, a policy, a policy declaration, a binder, or advice from a licensed insurance professional.

The availability of products, coverages, limits, deductibles, discounts, pricing, underwriting, eligibility requirements, and services varies by state, insurer, product, and individual circumstances. Not every product or coverage described on the Website is available to every person or in every location.

4. No Insurance Coverage Is Created

IMPORTANT: Using the Website, requesting a quote, submitting a form, communicating with the Agency electronically, or receiving an estimated premium does not create or bind insurance coverage.

Information displayed on the Website, including coverage descriptions, examples, premiums, discounts, estimates, and quote results, is not an offer to insure and does not constitute a binding insurance contract.

Insurance coverage is not effective unless and until:

  1. A complete application has been submitted;
  2. The applicable insurer has accepted the application;
  3. Any required payment or other underwriting requirements have been satisfied; and
  4. The applicable insurer has issued a policy, binder, or other written confirmation of coverage specifying the effective date.

A quote request or application submission may be subject to verification, underwriting review, inspection, credit-based insurance scoring where permitted, motor vehicle or claims-history review, identity verification, payment requirements, and other conditions.

No employee, agent, contractor, website feature, automated tool, email, text message, or other communication may change the terms of an issued policy unless authorized in writing by the applicable insurer.

If any Website content, quote, estimate, email, text message, application, or other communication conflicts with an issued insurance policy, endorsement, binder, declaration page, or other insurer-issued document, the applicable policy or insurer-issued document controls.

5. Farmers Coverage Review

The Farmers Coverage Review is an educational consultation intended to help identify potential coverage gaps, overlaps, or changes in insurance needs. A Coverage Review may consider major life events, changes in property or vehicles, household changes, business developments, and other information you provide.

A Coverage Review:

You remain responsible for reviewing your policies and informing the Agency or applicable insurer of material changes that may affect your coverage.

6. Information You Provide

When you use a quote form, contact form, Coverage Review form, appointment tool, or other Website feature, you agree to provide information that is accurate, current, and complete to the best of your knowledge.

You agree not to:

You understand that inaccurate, incomplete, or misleading information may result in an inaccurate quote, a delay, denial of coverage, cancellation, rescission, nonrenewal, claim consequences, or other action permitted by law or the applicable policy.

Submitting a form does not guarantee that the Agency will respond, provide a quote, schedule a consultation, or offer insurance.

7. Eligibility and Geographic Scope

The Website is intended primarily for residents and businesses located in Missouri, Kansas, and Arkansas, and for persons located in the United States who are seeking information about insurance products or services available through the Agency.

You may use the Website only if:

The Website is not intended to provide insurance services outside the jurisdictions in which the Agency and applicable insurers are properly licensed or authorized. Product availability and eligibility may differ by state.

If you access the Website from outside the United States, you do so at your own initiative and are responsible for complying with applicable local laws.

They are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and view the Website for your personal or internal business purposes. This license does not transfer ownership of any Website content or materials to you.

Except as expressly permitted by law or with prior written permission, you may not:

“Farmers,” “Farmers Insurance,” “Farmers Insurance Group of Companies,” related logos, and other Farmers names and marks are trademarks, service marks, or trade names of Farmers Insurance and/or its affiliates or related entities. Other names, logos, and marks appearing on the Website belong to their respective owners. Nothing in these Terms grants you any right to use those marks.

The Website may contain links to or integrations with third-party websites, applications, quote engines, customer portals, payment systems, social media platforms, or other tools. These may include websites or services operated by Farmers entities, insurers, service providers, technology vendors, or other third parties.

By submitting your contact information or using a Website form, you agree that the Agency may communicate with you electronically regarding your inquiry, quote request, Coverage Review, appointment, application, policy-related question, or other requested service.

Electronic communications may include email, telephone calls using automated or prerecorded technology where permitted, text messages, electronic notices, and links to documents or disclosures.

You agree that electronic records and communications may satisfy a legal requirement that a communication be provided in writing, when permitted by applicable law. Your consent to electronic communications does not by itself create insurance coverage or replace any policy-specific consent or application requirement.

You may withdraw consent to receive electronic communications by contacting us at (573) 289-3136. Withdrawal of consent may affect our ability to provide certain services electronically, and we may continue to send communications through other lawful means.

Separate consent may be required for electronic delivery of particular insurance documents, notices, disclosures, or legally required communications. Where required, the applicable insurer’s electronic-delivery consent and withdrawal procedures control.

You are responsible for keeping your email address, telephone number, mailing address, and other contact information current.

13. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy available at /privacy-policy.

The Privacy Policy is incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy concerning the handling of personal information, the Privacy Policy controls for that subject.

14. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT, INFORMATION, FEATURES, TOOLS, FORMS, LINKS, AND SERVICES MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGENCY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGENCY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE AGENCY AND THE PERSONS IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID, IF ANY, TO USE THE WEBSITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply regardless of the legal theory asserted and even if we were advised of the possibility of the damages. They do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, willful misconduct, or other liability that applicable law prohibits from being limited.

These Terms do not limit or modify rights or obligations under an issued insurance policy. Claims concerning insurance coverage, benefits, exclusions, duties, or policy interpretation are governed by the applicable policy and applicable law.

17. Availability and Termination

We may modify, suspend, restrict, or discontinue the Website or any portion of it at any time, with or without notice. We are not responsible for any resulting loss or inconvenience.

We may suspend or terminate your access to the Website if we believe you have violated these Terms, applicable law, or the rights of another person, or if suspension or termination is necessary to protect the Website, our users, or our business.

Upon termination, your right to use the Website will immediately end. Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, dispute resolution, and general terms.

18. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Website or these Terms will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Subject to the dispute-resolution provisions below and any rights that cannot lawfully be waived, any court proceeding relating to the Website or these Terms must be brought in a state or federal court located in or serving Boone County, Missouri, and you consent to that court’s personal jurisdiction and venue.

Nothing in this section limits any mandatory rights, remedies, administrative processes, or venue protections available under applicable insurance, consumer-protection, federal, or state law.

Unless and until such provisions are separately approved and included, nothing in these Terms requires arbitration or waives a right to bring a claim in court.

Disputes concerning an issued insurance policy, claim, coverage, premium, cancellation, nonrenewal, or underwriting decision may be subject to the policy’s terms and conditions and to applicable insurer complaint, appraisal, arbitration, mediation, or regulatory procedures.

20. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

21. Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, or any rights or obligations under them, in connection with a merger, reorganization, sale of assets, change in ownership, or operation of the Website.

22. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later. A waiver must be in writing and signed by an authorized representative of the Agency.

23. Entire Agreement

These Terms, the Privacy Policy, and any other terms or notices expressly incorporated by reference constitute the entire agreement between you and the Agency concerning your use of the Website and supersede prior or contemporaneous communications concerning that subject.

Additional terms may apply to specific products, services, applications, quote engines, customer portals, promotions, or third-party services. If additional terms conflict with these Terms, the specific additional terms will control for the applicable service or transaction.
